PRESENTATION: The Federal Circuit has recently taken an important patent damages issue en banc involving the admission of damages expert testimony that relied on prior license agreements to support a reasonable royalty opinion. In the case of EcoFactor, Inc. v. Google LLC, the en banc Federal Circuit ordered the parties to brief whether a district court abused its discretion in admitting damages expert testimony under Rule 702 and Daubert that relied on prior lump-sum patent license agreements to determine a reasonable royalty. The presentation will discuss prevailing Federal Circuit damages law as it relates to the use of prior license agreements, and how Rule 702 and its recent revisions apply to testimony from experts who rely on such agreements.
